الموضوع / رسالة جموع الشعب العراقي المعتصمة في ساحات العراق

تهديكم جموع الشعب المعتصمة في ساحات العراق أطيب تحياتها وتتشرف أن تبدي ما يلي :
أولا - عانت جموع الشعب في العراق في الأعوام من 2003 حتى ألان شتى صنوف القهر والظلم والاستبداد وانتهاك ابسط حقوق الإنسان في العيش بأمن وسلام، ومن ذلك ما يلي :

1. تعرض العراق في العام 2003 إلى غزو عسكري خارجي قادته الولايات المتحدة الأمريكية دون غطاء قانوني في تحد واضح وخرق فاضح لميثاق الأمم المتحدة وقواعد القانون الدولي وقواعد الأعراف الدولية، وقوضت باستخدام القوة نظام الحكم السياسي المنتخب فيه في مخالفة واضحة للفقرة (4) من المادة 2 من ميثاق الأمم المتحدة التي تحرم مجرد التهديد بالقوة، وانتهكت مبدأ السيادة الدولية للعراق والاستقلال السياسي له ومبدأ عدم التدخل في الشؤون الداخلية للدول الذي أكدته الفقرة (7) من المادة 2 المذكورة آنفا.

2. خضعت جمهورية العراق لاحتلال أجنبي بزعامة الولايات المتحدة الأمريكية وبريطانيا بموجب قرار مجلس الأمن رقم 1483 لسنة 2003 ، حيث كان هذا القرار خارج قواعد القانون الدولي لمخالفته ميثاق الأمم المتحدة وكونه قد اقر سلب سيادة دولة عضو مؤسس في الأمم المتحدة وتسليمها لمحتل أعلن أن هدفه نزع السيادة وتغيير النظام السياسي لها واستبداله بنظام ينسجم مع مشروعه الكبير للهيمنة على المنطقة كلها. إن مجلس الأمن في قراره هذا قد خرق الميثاق نفسه، ووافق على استخدام القوة غير المشروعة ، وأعاد حالة الاحتلال والوصاية على الدول التي انتهت أصلا بإقرار مبدأ حق تقرير المصير في الميثاق نفسه .

3. تصرفت دولتا الاحتلال في الشؤون الداخلية للعراق ومارست السلطات التشريعية والقضائية والتنفيذية فيه وهذا خرق واضح لمفهوم الاحتلال الذي أقرته الاتفاقيات الدولية ومنها على سبيل المثال لا الحصر اتفاقيات جنيف لعام 1949.

4. لم تكتف أمريكا باحتلال العراق بل جاءت بعملائها وأسست حكومات لا تمتلك سلطة اتخاذ القرارات طيلة فترة بقائها في العراق، واضطرت فيما بعد إلى تركه مكرهة بفعل الضربات القوية التي وجهتها المقاومة العراقية الباسلة له، وخلفت وراءها حكومات تسمي نفسها منتخبة من فبل الشعب وفق دستور أسمته دائما في صياغة تخلو من كل معاني القانون والحق والعقل والمنطق ، وتظهر فيه كل معاني الطائفية والتمييز العرقي والمذهبي وفي تناقض واضح لقرارات الأمم المتحدة المعنية بمحاربة التمييز والفصل العنصري .

ثانيا – مارست الحكومات المشكلة بعد انسحاب القوات الأمريكية مكرهة من العراق وبشكل خاص منها حكومة المالكي الحالية وأجهزته القمعية أبشع صنوف الظلم والاضطهاد ضد الشعب العراقي أمام مرأى ومسمع العالم كله، وفي ظل صمت غريب ومريب من الدول والمنظمات الدولية التي يجب أن ترعى وتدافع عن حقوق الإنسان،وندرج في أدناه بعضا من هذه الممارسات :

1. تمارس حكومة نوري المالكي في العراق كل أنواع الفساد والكبت والقمع لأبناء الشعب العراقي.
2. تمارس الحكومة العراقية الحالية انتهاكات أخلاقية ونفسية وجسدية لحرائر العراق العفيفات واللاتي تجاوز عددهن الآلاف في معتقلات الحكومة العراقية المستبدة.
3. تقوم حكومة المالكي بممارسات عنصرية وطائفية بغيضة تنم عن حقد وتشفٍ بغيض تفقد به أهليتها لحكم العراق.
4. تتحدث حكومة نوري المالكي بأسلوب التهديد والوعيد لكل الناس الذين يقولون لا للطغيان لا للدكتاتورية لا للطائفية البغيضة لا للاستبداد.
5. ممارسة التعذيب والاغتصاب للسجينات من النساء خاصة في سجن الكاظمية في بغداد وبابل باعتراف السلطات الحكومية نفسها.
6. استخدام القوة والإكراه في اخذ الاعترافات من السجناء خلافا للقوانين المرعية خلال فترات التحقيق والاحتجاز.
7. وجود سجون سرية للمعتقلين لا تتبع لوزارة العدل وهي الجهة المسؤولة عن السجون في العراق.
8. إتباع سياسات الإقصاء والتهميش للكثير من مكونات الشعب العراقي ، سواء من هم في السلطة أو خارجها.

9. تشريع قانون للإرهاب، يسمح لأجهزة حكومة المالكي بإلقاء القبض والحجز دون محاكمة لكل من يقف في وجه سياستها الطائفية والعنصرية، وهناك الكثير من السجناء الأبرياء تحت مسمى الإرهاب لمجرد معارضة تلك السياسة.

10. تشريع قانون يسمى " قانون المسآلة والعدالة" لمعاقبة رموز وأقطاب نظام حكومة حزب البعث السابق، وحرمانهم من حقوقهم الوظيفية والتقاعدية بدعوى الانتماء السياسي لهذا الحزب الذي تم حظر نشاطاته السياسية، والتهديد لكل المعارضين الذين يشكلون الطبقة الفاعلة والرائدة في المجتمع لسياسة الحكومة الحالية بتطبيق هذا القانون عليهم، وحرمانهم وعوائلهم من ابسط الحقوق القانونية.

ثالثا: تدعو جموع الشعب العراقي المظلومة والتي تظهر احتجاجاتها واعتصاماتها السلمية في عموم محافظات العراق على شاشات التلفزة الفضائية وأجهزة الاتصال الأخرى كل الدول والمنظمات الدولية والإقليمية وجمعيات حقوق الإنسان ومؤسسات المجتمع المدني وكل المنتديات الدولية والإقليمية الأخرى إلى الوقوف إلى جانب جموع الشعب العراقي المضطهد، والعمل على دعم جهودهم السلمية لنبذ كل أشكال العنف الحكومي والتسلط الدكتاتوري البغيض في العراق ، واتخاذ الإجراءات الضرورية بوجه الممارسات التعسفية التي تقوم بها حكومة نوري المالكي، ووقف أي تعامل سياسي أو اقتصادي أو تجاري مع حكومة نوري المالكي ما دامت لا تحترم ابسط قواعد حقوق الإنسان التي أكدتها الشرائع السماوية والشرائع الوضعية ومنها لوائح الشرعة الدولية لحقوق الإنسان.

تنتهز جموع الشعب العراقي هذه الفرصة للإعراب عن فائق شكرها وتقديرها وهي بانتظار الإجابة لمطالبها القانونية المشروعة.

Iraqi People masses present its compliments to His Excellency (Ban Ki-moon) the Secretary General of the United Nations and honor to mention the following:

First - Iraqi People suffered for a long times since 2003 till now various forms of oppression, injustice, tyranny and the violation of the most basic human rights to live in peace and security. The examples of that are the following:

1. In 2003 Iraq Exposed to the outside military invasion led by the United States without legal cover in clear challenge and flagrant violation of the Charter of the United Nations and the rules of international law and international custom. USA undermined by the use of force the elected political regime of Iraq. That was a clear violation of paragraph (4) of Article (2) of the United Nations Charter which prohibits the mere threat of force. USA violated the principle of Iraqi sovereignty, and its international political independence, in addition of the non-interference principle in the internal affairs of States, which was confirmed by paragraph (7) of Article 2 above.

2. Republic of Iraq subjected to foreign occupation led by the United States and Britain under Security Council resolution 1483/2003. The decision violated clearly the rules of international law provided by Charter of the United Nations. The decision has admitted to loot the sovereignty of a founding member of the United Nations and delivered to the occupier stated aiming to change political system and replace it according with a great desire to controlling the entire region. The Security Council in its resolution that may breach the Charter itself, and agreed on the use of non-legitimate force, returning the case of former imperialist occupation and the International trusteeship States, which ended originally by adopting of the principle of the right of self-determination by the Charter itself.

3. the two occupying states of Iraq acted in the internal affairs and exercised legislative, judicial and executive powers, which was clear breach of the concept of occupation, approved by international conventions, like, for example, the Geneva Conventions of 1949.

4. USA not only did occupied Iraq but came customers and established governments do not have the authority to make decisions for the duration of its staying in Iraq. Later USA was forced to leave by the heroic Iraqi resistance. It left governments call themselves elected by people according to a sectarian Constitution Abandoning of all meaning of the law, the right, and logic. The Iraqi now Constitution appears all the meanings of sectarian, ethnic and religious discrimination in clear contradiction with the United Nations resolutions on the fight against discrimination and apartheid.

Second- The Iraqi governments formulated after the forcing withdrawal of USA military of Iraq especially the current Maliki government and its repressive organs practices worst forms of injustice and oppression against the Iraqi people which all the world hear and see. The States and international organizations are stay in the strange silence and suspicious that should take care of and defend human rights. In below some of these practices:

1. The Iraqi government of Nouri al-Maliki exercises all kinds of corruption, oppression and repression of the Iraqi people.
2. The current Iraqi government exercise ethical violations of physical and psychological silks against women who their number exceeded of thousands in detention by the tyrannical Iraqi government.
3. The Maliki government practices racist and hateful sectarianism reflect the hatred and helpfulness repugnant lose their capacity to govern Iraq.
4. The government of Nouri al-Maliki talk in a threatening manner to all the people who say no to tyranny, no to dictatorship, no to sectarian, no to odious tyranny.
5. There are Torture and rape of prisoners of women, especially in the Kadhimiy in Baghdad and Babylon prisons which Recognized by the government authorities them self.
6. The Iraqi authorities use the force and coercion to take confessions from prisoners, contrary to the laws during the investigation and detention.
7. There are many secret prisons for detainees existing by the other government organs not belong to the Ministry of Justice who responsible for prisons in Iraq.
8. The Iraqi government follows the policies of exclusion and marginalization of many of the components of the Iraqi people, whether they are in or out of power.
9. The Iraqi government have a Act of terrorism legislation, allows to the Maliki organs to arrest and detention without trial for each who not with its sectarian and racist policy, and there are a lot of innocent prisoners under the name of terrorism just to oppose such a policy.

10. There is a legislation of the so-called "law of the justice and accountability" to punish the members of the former government of Baath Party, denying of their functional rights and under the pretext of political member to Baath party that was banned his political activities, threat of all opponents of the current government policy to apply the law to them, depriving them and their families of the simplest legal rights .
Third – The Iraqi People masses who oppressed now that show peaceful protests in all provinces in Iraq clearly appear on satellite television and other communication devices call upon all States, international and regional organizations, human rights associations and civil society to stand by the masses of peaceful Iraqi people oppressed, and work on support them renouncing all forms of government violence and authoritarianism the dictatorial obnoxious in Iraq. They should take all the necessary actions to stop abusive practices of Nouri al-Maliki government, and stop any political, economic or business dealings with this government as long as it does not respect the most basic human rights and custom confirmed heavenly by regulation, laws and the International Bill of Human Rights.

Waiting for the answer to their legal legitimate demands,
the Iraqi people masses Seize the opportunity to express their deep thanks and appreciation.
